Are you required to drug test your drivers?

If you meet one of the following criteria, you will need to have a DOT FMCSA Drug and Alcohol Testing Program:

  1. Gross Vehicle Weight Rating (GVWR) or Gross Combination Weight Rating (GCWR) of 26,001 lbs. or more
  2. Transporting 16 passengers or more
  3. Transporting Hazardous Materials requiring placarding

If you’re not sure, the US DOT has an online tool so you can check. We help companies get started all the time. Ask us.

Our DOT employees are FAA, FTA, FRA, PHMSA or USCG.

An FMCSA, DOT-compliant drug testing program has 6 key requirements

Written Policy

A Drug-free workplace policy is the backbone of your drug-testing program. It informs why the company tests, how it tests, and the consequences of non-compliance. InOut Labs will review your current drug-free policy. If you don’t have one, we’ll help you produce one. It should be fair, clear, and effective.

Supervisor Training (Reasonable Suspicion)

We’ll train supervisors how to recognize a drug or alcohol problem, and help them feel comfortable with their responsibilities. What is she allowed to do? What must she do? Training can be in person or via web, or a combination.

Employee Assistance

You’ll have the tools to detect problems, but not the expertise to help employees with substance abuse issues. You don’t have to pay for for it, but if an employee has a substance problem, you need to provide a resource.

Employee Education

We’ll supply the materials that set the proper expectations. (Every so often, people mysteriously resign at this stage, which tells you the program is already making your workplace safer.)

Testing

Random testing is the best deterrent. We also test for pre-employment, post-accident, return to duty, and follow-up (especially for DOT-regulated companies). The FMCSA requires that 50% of drivers be randomly tested for drugs and 10% for alcohol (effective 1/1/20).

FMCSA Clearinghouse

As of January 6, 2020 every employer who employs CDL drivers who are subject to drug testing, must comply with the Clearinghouse. And there are a LOT of requirements. Learn more here.

Can it be fair, legal, and cost-effective?

Certainly, and we’re happy to show you how
