Actual Knowledge | FMCSA | Drug & Alcohol Testing
In this video, we explain what is "Actual Knowledge" when it comes to Drug & Alcohol Testing as regulated by FMCSA.
If as an employer you come across the following circumstances, it's "Actual Knowledge"
- A driver has used alcohol or controlled substances based on the employer’s direct observation of the employee
- Information provided by the driver’s previous employer(s)
- A traffic citation for driving a CMV while under the influence of alcohol or controlled substances
- An employee’s admission of alcohol or controlled substance use
Actual Knowledge is also reportable to the FMCSA Clearinghouse, which goes into effect on 6th January 2020.
It's necessary for employers of CDLs (Commercial Driver's License) to understand what is "Actual Knowledge" as it can be easily overlooked, resulting in a violation of FMCSA regulations.
For non-regulated employers, this may be an item you would like to address in your written policy.

What does "same day drug testing" mean?
The term "same day drug testing" can be slightly misleading.
So what does it really mean? Does it mean getting your results the same day or collecting specimen the same day?
Well it depends on the type of drug test you choose from the 2 listed below:
1) Instant or Rapid/POCT (Point of Collection Test) drug test can most likely give you results the same day, only if it's a negative result. A positive drug test can be followed up with a confirmation lab based drug test.
2) Lab based drug tests take longer. In a lab based drug test, same day would usually mean the specimen is collected the same day with results coming in after 24-48 hours.
Times can vary depending on a number of factors like the specimen getting hung up due to bad weather and shipping delays.

Shy Bladder in a DOT Drug Test | Employment Drug Testing at InOut Labs
A DOT drug test has a specific process to deal with donors having a shy bladder. Shy bladder is when the donor cannot produce a specimen sufficient enough for the urine drug test s/he has to remain at the collection facility until s/he can produce one.
In a nutshell this is what DOT rules under 49 CFR part 40, at paragraph 40 .193. say:
- For DOT testing the minimum amount of urine required is 45 ml
- Specimens from different voids cannot be combined
- Donors are permitted up to 40 oz. of water and up to 3 hours.
- At the 3 hour mark it becomes a “Refusal To Test”
- If a donor leaves the collection site before providing sufficient specimen, it is considered a “Refusal To Test”
- Most shy bladder cases resolve themselves in 30 min. or less
