Yes, the collector may accept the ID if it has expired for one year or less.

DOT gave guidance in the preamble to the oral fluid final rule, 88 Federal Register 27605 (May 2, 2023):

“The issue of employees using expired forms of ID at the collection site continues to cause problems. For several years, we have advised collectors to accept an expired photo ID issued by a Federal, State, or local agency. The condition is that the ID must not have been expired for more than one year. This guidance appears in the current ODAPC Urine Collection Guidelines. ODAPC will also add it to the Oral Fluid Specimen Collection Guidelines.”
