Under FMCSA rules, when an accident causes disabling damage to a motor vehicle, the driver must take a Post-Accident test only if they receive a citation. If the accident results in bodily injury that requires immediate medical treatment away from the scene, the same rule applies. However, if the accident involves a human fatality, Post-Accident testing is always required. Employers with a general drug and alcohol policy can require post-incident testing and conduct a non-Federal test.
