No. Even if the accident meets the FMCSA definition of an accident requiring testing, it is too late. The regulations require employers to test drivers for controlled substances and alcohol use as soon as practicable after an incident. If the employer does not administer an alcohol test within eight hours, they must stop all attempts. The employer must also conduct a Post-Accident testing for controlled substances within 32 hours. Employers should document all test-related actions and decisions.
