What if a driver is involved in an accident?

The rules for Post-Accident Testing state that if a vehicle is towed from the scene of an accident and the driver receives a traffic citation, that the employer must conduct a DOT Post-Accident Drug and Alcohol Test.

Rule of Thumb: No ticket, no test.

The Post-Accident Breath Alcohol Test must be conducted within 8 hours of the accident, and the Post-Accident Drug Test within 32 hours.

But what if the citation is issued a week later?

There is no need to conduct an alcohol or a drug test if more than eight hours and 32 hours, respectively, have passed since the accident happened.

Makes sense, but it is a reasonable question to ask.
